I don't know how anybody could possibly comment on this woman - she has practically no record on any significant issue. She was just recently appointed to the 5th Cir., and I'm not about to browse her District opinions. So I can't say if she's really "terrible" or "good." In fact, I don't see how anybody but a ED LA follower could possibly form an opinion.
But this does lead me to my next thought...
The fact that we are in a position in our society now where we are picking judges (Supreme and otherwise) simply because they are "female" or "Hispanic" is absolutely ridiculous. I mean, there are some brilliant conservative legal thinkers out there (Wilkinson, Luttig, Roberts) that, while I'd object to on a personal level, would at least be better candidates for the vacancy. And yes, they're white males.
We need more heavyweights on the court, not choices based on political correctness. Maybe Clement will prove me wrong and turn out to be some brilliant legal thinker or something... but I'm not holding my breath.
Ok, I guess I'll go ahead and allow everyone to form their opinions about Clement's judicial ability...
But before you do, take a look at those cases. The reduction of damages case makes her look cold hearted... but judges reduce pain/suffering damages all the time. The other big one is pretty worthless - arguing for non-aggregation of criminal charges under the Hobbs Act? Not exactly Roe v. Wade material there. And it's really not all that much to form an opinion about her legal arguments. Just like Kerry's Senate votes could be taken out of context and criticized, so too can one or two opinions by a judge.
It will be interesting to see what we learn during the confirmation hearings.
